Terms and Conditions of Sale

1. General

  • 1.1 The customers signature/ or telephone/ email confirmation and signature of person representing Property Kidd together with payment of 50% of total shown on front of this form shall constitute a binding agreement between the customer and
  • Property Kidd Pty Ltd from the date there on.
  • 1.2 This document shall be governed and interpreted according to the laws of Western Australia and the parties shall submit to the jurisdiction of the courts of Western Australia.
  • 1.3 This document constitutes the entire agreement between the parties and supersedes all previous representations, warranties, covenants and agreements not contained or recorded in this document. Any additional terms, conditions, warranties or agreements may be incorporated by reducing them to writing, signed by both parties and attaching them to this document.

2. Cancellations And Changes

  • 2.1 Any cancellation of an order must be by a notice of writing to Property Kidd.
  • 2.2 Our products are custom made and once the product has been ordered with a deposit and production costs have been incurred the order cannot be cancelled without incurred cost to the purchaser. Whilst Property Kidd make all attempts to action any request for changes or cancellations with out charge, the purchaser shall be liable to Property Kidd for up to the maximum value of the original order.
  • 2.3 The priced quoted on this order for supply of goods and services referred to may be changed by Property Kidd with a period of 7 days from the date hereof and the customer shall be at liberty to cancel this agreement with written notice to Property Kidd informing of their non-acceptance of varied price. All monies paid to Property Kidd shall be refunded to customer.

3. Title Retention

3.1 All goods remain the property of Property Kidd and ownership of goods will not be passed onto customer until payment is made in full. The warranty will not come in to effect until full payment of invoice has been made.

4. To The Customer

  • 4.1 Property Kidd agrees to supply as part of its contract, all materials in accordance with its own or manufacturers guidelines and recommendations.
  • 4.2 Property Kidd agrees to undertake all necessary precautions during its own installations and to carry out fitting in a professional way. Customers are to provide access and all installations are fitted to best endeavor.
  • 4.3 Property Kidd will inform the customer to the best of their knowledge the manner in which the products may be applied.

However, no claims for compensation will be accepted against assumptions made in respect of our operations, installations and product capabilities.

  • 4.4 Deliver and installation is included in our quote.
  • 4.5 Installation times given will be deemed correct at time of order placement, however as a custom-made product, all installations times stated shall be for guidance onlv and shall not be deemed as part of an contract with Property Kidd unless otherwise specified. The customer will be informed of any delays outside the time frame.

Payment Terms

  • 5.1 The terms of payment shall be the remaining balance paid by EFT, Card, Cheque or cash on day of installation.
  • 5.2 Property Kidd shall be at liberty in its absolute discretion to charge interest on all overdue accounts at an annual rate of

15% and to charge any expense incurred in recovering any outstanding monies.

Guarantee

Property Kidd warrants that for 5 years all parts/componentry of all products (except for those items listed under the section

‘This Warranty Does Not Cover”) that prove to be defective in materials or workmanship shall be covered free of charge, subiect to the terms and conditions of this warrant. Labour mav be charged if deemed that not a fault of workmanship or product. The warranty period begins at the date of installation and is provided to the original owners of the product.

Warranty Does Not Cover

  • Any product that has been relocated from its intended area
  • Unauthorized modification or use of any non-genuine
  • Non-Property Kidd supplied parts, accessories or equipment
  • Alterations, tampering, or improper repairs or servicing
  • Damages, or failures from severe weather
  • Accidents and Theft Damage
